Areas of Practice


Erin Berman concentrates her practice on special education litigation. She advises school districts on a wide variety of issues, including unilateral placements, manifestation determinations, independent evaluations, and “stay-put.”

Prior to joining Comegno Law Group, Erin served as a law clerk with the Office of Administrative Law provided a strong foundation for her work on behalf of school districts. As a law clerk, she drafted initial decisions and memoranda of law on a wide spectrum of education law issues, including special education, school laws, school board ethics, teacher tenure and licensing. She developed expertise in IDEA and Section 504 claims, including manifestation determination reviews, unilateral placement reimbursement claims, and LRE issues. She advised Administrative Law Judges on evidentiary issues, expert testimony, and the procedural requirement of IDEA. Her work addressed high profile political issues, including changes to superintendent compensation and contract litigation.

Erin developed litigation experience as a Deputy Attorney General. She litigated guardianship cases, honed her trial skills, and mastered the nuances of child protection law and policy. She advised DCP&P on appropriate case plans for children in placement, drafted and filed complaints, devised litigation strategies, represented DCP&P in monthly compliance review hearings, subpoenaed and compiled relevant documentary evidence, prepared lay and expert witnesses, managed mediations, litigated trials, and filed appellate briefs. She built strong professional relationships with stakeholders, including the courts, the Offices of the Law Guardian and the Public Defender, forensic experts, and of course, DCP&P.

Prior to law school, Erin taught special education and English in various urban districts. She attended law school to better understand how underserved schools can better serve students. Immediately prior to joining Comegno Law Group, Erin taught criminal law to Newark public school students. As a teacher of law with the Thurgood Marshall Law Academy, University High School, she developed students’ literacy and critical thinking skills through the exploration of criminal law.

Erin earned her JD from Rutgers School of Law-Newark. During law school, Erin was a member of the Minority Student Program (MSP), and served as both an MSP mentor and MSP mentor coordinator. She mentored high school students in Newark through the Street Law Program. In her second year of law school, Erin served as an associate editor of the Computer and Technology Law Journal. She earned a BA in English from Rutgers University, Douglass College. While at Douglass College, Erin was very active in student and community organizations. She is certified as a highly qualified Teacher of English.

Erin is a member in good standing of the New Jersey bar. She holds a standard certificate as a highly qualified Teacher of English.

In her spare time, Erin is active in the Jewish community.
