Special Needs Trusts
Our attorneys regularly assist in the establishment of Special Needs Trusts to protect assets while enabling disabled individuals to enjoy an enhanced quality of life and receive appropriate public benefits. These kinds of trusts allow disabled beneficiaries to receive gifts, lawsuit settlements, or other funds without losing eligibility for certain government programs since the funds will not be considered to belong to the beneficiary in determining eligibility for public benefits.
We also have experience establishing “self-settled” trusts on behalf of individuals disabled in an accident or medical malpractice in order to properly safeguard proceeds of a personal injury award or settlement.
